2. About these terms

These Terms of service apply to every purchase you make on truetosoleedit.com. Please read them before you order. You can save or print them at any time. They sit alongside our Shipping policy, our Refund policy and our Privacy policy.

These terms are available in English, and your contract with us is concluded in English. We do not subscribe to any code of conduct.

Nothing in these terms limits the rights you have as a consumer under the law of the European Union, of Romania or of the country where you live.

3. Our pieces

We sell pre-owned luxury handbags, small leather goods and accessories, and occasionally watches. Every piece is one of one: there is exactly one of each.

Each product page describes the piece, shows photographs of the piece itself and gives its condition grade with the meaning of that grade, followed by notes on its specific wear. We use seven grades:

  • New: brand new, never used.
  • Like New: like new, with barely any signs of use.
  • Excellent: slight signs of use.
  • Very Good: some signs of use.
  • Good: normal signs of use, with some flaws and light soiling.
  • Fair: obvious signs of use, with some flaws and soiling.
  • Well Worn: very obvious signs of use, with obvious flaws, soiling and damage.

The grade guide is also on our Authentication page. Some pieces are sourced to order from our partners; the product page marks them, with their longer delivery time, before you buy.

4. Authenticity

Our team checks every piece before it is sent to you. Pieces sourced to order are checked when they reach us, before they go on to you.

Every purchase includes a Vaultik digital certificate of authenticity. Vaultik is operated by Mintouge Ltd (United Kingdom), trading as Vaultik / Collect App. It authenticates each piece with a multi-agent AI analysis, with human expert review as an additional layer of verification. Where available, the link to the certificate is on the product page, so you can check it before you buy. The certificate records Vaultik's assessment of the piece at the time it was authenticated.

If a piece does not have its Vaultik certificate yet when you order, its product page says so, and Vaultik authenticates it before we dispatch it (section 8). If a piece does not pass authentication, we do not send it: we cancel your order and refund everything you paid, in full, without undue delay and at the latest within 7 days of the authentication result.

After your purchase, the certificate is registered in your first and last name. The certificate page is public, so anyone with its link can see the name of the registered owner. If you would rather your name did not appear, tell us and we will have it removed; the certificate then stays registered to our shop. Our Privacy policy explains how we share your details with Vaultik.

The certificate is a record of the authentication, not a separate guarantee from us or from Vaultik. If a piece does not match its description, for example because it is not authentic, you are protected by the legal guarantee of conformity (section 10) and by every other right the law gives you.

5. Ordering and your contract

  • Add the piece to your bag and go to checkout.
  • Enter your email address, your delivery address and your payment details.
  • Review your order. Until you place it, you can go back at any step to correct your details or change your bag.
  • Place your order with the button that confirms your obligation to pay (for example "Pay now").

Placing your order is your offer to buy the piece. We then send you an order confirmation by email, confirming that we have received and accepted your order. Your contract with us is concluded when we send that email.

We keep a record of your contract. Your order confirmation sets out its details, and on request we will send you a copy of the terms that applied to your order.

If, exceptionally, we cannot deliver a piece you have ordered, we will tell you straight away and refund everything you paid without undue delay, and at the latest within 7 days.

6. Prices and VAT

Our prices include VAT, and delivery is free, so the price at checkout is the total you pay, with one exception. For deliveries to EU territories outside the EU VAT area, such as the Canary Islands, customs or tax formalities apply and local import taxes may be charged to you on arrival. Our Shipping policy lists these territories.

Our prices are set in euro (EUR). For delivery to any EU country other than Romania, you see and pay the same euro price. For delivery to Romania, prices are shown and charged in Romanian lei (RON). We convert them from our euro price and include a small allowance for currency conversion costs, so a lei price can be slightly higher than the euro price at the day's exchange rate. Lei prices follow the exchange rate, so they can change from day to day. The price that applies is the one shown when you place your order.

Our pieces are sold under the special margin scheme for second-hand goods. VAT is charged only on our margin and is included in the price, so it is not shown as a separate amount on your invoice and cannot be deducted by the buyer. Your invoice carries the margin-scheme mention required by Romanian law ("regimul marjei - bunuri second-hand").

7. Payment

We accept Visa, Mastercard, American Express, Maestro, UnionPay, Apple Pay, Google Pay and Shop Pay, and in some countries local payment methods. Checkout shows the methods available for your country and currency. Payments are processed securely by Shopify Payments, and we never see your full card details. Payment is taken when you place your order.

You pay in the currency shown at checkout: euro, or lei for delivery to Romania (section 6). If your card is in another currency, your bank may apply its own exchange rate and fees.

8. Delivery

We deliver free of charge to addresses in all 27 member states of the European Union. We do not deliver outside the EU. For deliveries to EU territories outside the EU VAT area, such as the Canary Islands, local import taxes may be charged to you on arrival (section 6).

  • Pieces in stock with their Vaultik certificate are dispatched within 1-2 working days and delivered within 2-4 working days of dispatch.
  • Pieces in stock without a Vaultik certificate yet are authenticated by Vaultik before dispatch, and the product page says so. They are dispatched within 1-2 working days of authentication and delivered within 2-4 working days of dispatch. If a piece does not pass authentication, we cancel your order and refund you in full (section 4).
  • Pieces sourced to order from our partners reach you in approximately 15 working days.

Every parcel is tracked and insured, and a signature is required on delivery. The piece stays at our risk until you, or a person you name other than the carrier, take physical possession of it.

If your piece does not arrive in time, please tell us. You may give us a reasonable extra period to deliver, and if we still do not deliver, you may end the contract and we will refund everything you paid within 7 days. Full details are in our Shipping policy.

9. Your right to withdraw

You may withdraw from your purchase within 14 days, without giving any reason. The 14 days start on the day you, or a person you name other than the carrier, take physical possession of the piece. If one order arrives in several parcels, they start on the day you receive the last one.

To withdraw, tell us before the 14 days have ended, in any of these ways:

  • online, with our withdrawal function: open Withdraw from contract here and confirm your withdrawal. You will see a reference with the date and time, and we will send you an acknowledgement by email without undue delay;
  • by any clear statement sent to hello@truetosoleedit.com or by post to our registered office;
  • with the model withdrawal form in our Refund policy, which you may use but do not have to.

Send the piece back without undue delay, and at the latest within 14 days of telling us, to the return address we send you with our acknowledgement of your withdrawal. You bear the direct cost of returning the piece.

Please return the piece with everything it came with: its accessories, dust bag, cards, tags and packaging. You may examine the piece as you would in a shop. You are liable only for any loss in value caused by handling it beyond what is necessary to establish its nature and characteristics.

We refund all payments we received from you within 14 days of receiving your withdrawal, using the same payment method and at no cost to you. We may withhold the refund until we have received the piece back or you have shown us that you have sent it, whichever comes first. If you withdraw, we also remove your name from the piece's certificate of authenticity.

The full rules and the model withdrawal form are in our Refund policy.

10. Legal guarantee of conformity

Every consumer purchase in the European Union is covered by a legal guarantee of conformity. For your purchase from us it is set out in Romanian law (OUG nr. 140/2021, which implements Directive (EU) 2019/771), and it applies in addition to your right to withdraw.

  • We are responsible for any lack of conformity that exists when the piece is delivered and becomes apparent within two years of delivery.
  • For second-hand goods the law allows a seller and a buyer to agree a shorter period of at least one year. We do not ask you to agree to a shorter period, so the two years apply to every piece we sell.
  • A lack of conformity that becomes apparent within one year of delivery is presumed to have existed at delivery, unless we prove otherwise.
  • If the law of the country where you live gives you a longer period, a longer presumption or further remedies, you keep them.

What conformity means for a pre-owned piece

A piece conforms when it matches its description, condition grade, wear notes and photographs, and has the qualities you can reasonably expect of a pre-owned piece of its type, age and grade. The condition grade, the wear notes and the photographs are part of the description of the piece you buy. Signs of use that are normal for the stated grade, and flaws that the product page described and showed before you ordered, are part of the piece and are not a lack of conformity. A flaw that the product page did not describe, or one that is more serious than described, is covered by the legal guarantee.

Your remedies

  • You may ask us to bring the piece into conformity free of charge, within a reasonable period agreed with you in writing and no longer than 15 calendar days from when you tell us about the problem. As every piece is one of one, this usually means repair, because replacement is rarely possible.
  • You may ask for a proportionate price reduction, or end the contract, if repair or replacement is impossible or disproportionate, if we refuse or fail to carry it out, if we make clear that we will not do so within a reasonable time or without significant inconvenience to you, if the problem remains despite our efforts, or if it is serious enough to justify this straight away. You cannot end the contract for a minor lack of conformity.
  • If you end the contract, you send the piece back at our cost, and we refund the price, using the same payment method and at no cost to you, when we receive the piece or proof that you have sent it.

After the two years, Romanian law also lets you ask for repair or replacement of a piece that cannot be used for its purpose because of a hidden defect that appears within its average period of use.

We do not give any commercial guarantee in addition to this legal guarantee.

Before you order, our website shows the official EU notice summarising your legal guarantee rights, and you can read it at any time on our page Your legal guarantee rights. You can read more about these rights on the European Commission's Your Europe website: https://europa.eu/youreurope/guarantees.

If you notice a problem, please contact us as soon as possible at hello@truetosoleedit.com or through our contact form, with your order number, a description of the problem and, ideally, photographs.

11. Liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or of our negligence. Nothing in these terms excludes or limits our liability where the law does not allow this, including liability for death or personal injury caused by our negligence, for fraud, or for intentional or grossly negligent conduct, and nothing in them affects your statutory rights.

We are not responsible for delays or failures caused by events beyond our reasonable control. If such an event affects your order, we will tell you promptly, and if it continues you may cancel and receive a full refund. This does not affect your rights under the legal guarantee of conformity (section 10), your right to withdraw (section 9), or our responsibility for the piece until it is delivered to you (section 8).

12. Complaints and disputes

If something is not right, please tell us first: by email at hello@truetosoleedit.com, through our contact form or the WhatsApp chat on our website, or by post to our registered office. Please give your order number, describe the issue and add photographs where they help. We acknowledge your complaint within 2 working days and give you a full answer within 14 days of receiving it. For anything you may need to prove later, such as a complaint, email or post is best, because it gives you a dated written record. To withdraw, you can also use our online withdrawal function (section 9), which gives you a reference with the date and time.

If we cannot resolve the matter together, you can use the alternative dispute resolution (SAL) service of the Romanian National Authority for Consumer Protection (ANPC) at https://reclamatiisal.anpc.ro. General information is available at https://anpc.ro. If you live in another EU country, the European Consumer Centre in your country can advise you free of charge on cross-border disputes. You can also go to court (section 13).

13. Governing law and courts

These terms, and every contract concluded under them, are governed by Romanian law. If you live in another member state of the European Union, you also keep the protection of the mandatory consumer rules of that country, and where those rules protect you more, they apply.

You may bring proceedings in the courts of Romania or in the courts of the country where you live. We may bring proceedings against you only in the courts of the country where you live.

14. Offers

From time to time we offer discount codes. Unless an offer says otherwise, you can use one code per order, a code cannot be combined with another code or offer, codes have no cash value, and they cannot be added to an order you have already placed. If you withdraw from an order that used a code, we refund the amount you actually paid.

Welcome offer

  • When you sign up for our newsletter in the pop-up window on our website, we show you a welcome code on screen straight away. It gives you EUR 50 off your first order with us when the order is worth EUR 300 or more, before shipping.
  • The code is for customers who have signed up and have not ordered from us before. It works once per customer, on a first order only, and we check this with the email address you use at checkout.
  • For delivery to Romania, the EUR 50 and the EUR 300 minimum are converted into lei at checkout.
  • We may end the welcome offer at any time. We will say so on our website, and the code then stops working. Orders already placed keep their discount.

Birthday offer

  • When you sign up in the pop-up window on our website, you can also give us your birthday (optional, day and month only). A few days before your birthday, our team then sends you a personal greeting with a birthday code: 10% off one order.
  • The code is personal: it works only with the email address you signed up with, and only once. It is valid from 3 days before your birthday until the end of the 30th day after it (Bucharest time), as long as you stay subscribed to our newsletter. If you unsubscribe, an unused code stops working.

15. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the one published on our website when you placed it.
